This document is a public offer under Articles 633 and 641 of the Civil Code of Ukraine to enter into a contract for the sale of the products presented on blackpack.ua on the terms set out below.
1. Seller

2. Definitions
Website — the online store at blackpack.ua.
Buyer — an individual or legal entity placing an order on the Website.
Products — bags, backpacks, accessories and other goods presented on the Website.
Order — the Buyer’s request to purchase Products placed on the Website.
3. Conclusion of the contract
3.1. The contract is concluded when the Buyer places an Order on the Website and confirms acceptance of this Offer. The contract is concluded electronically in accordance with the Law of Ukraine “On Electronic Commerce”.
3.2. To place an Order, the Buyer creates an account and provides accurate details: name, phone, email and delivery information. The Seller may contact the Buyer to confirm the Order.
3.3. If an ordered Product turns out to be unavailable, the Seller informs the Buyer and offers a replacement, a wait, or a full refund.
4. Price and payment
4.1. Prices are shown in the currency displayed on the Website; VAT is not charged. The price is fixed at the moment the Order is placed. Delivery is not included in the price unless stated otherwise on the Website.
4.2. Payment methods:
online payment by Visa or Mastercard via the WayForPay payment service;
payment in instalments (where available in the payment service);
cash on delivery at a Nova Poshta branch (delivery within Ukraine only);
bank transfer to the Seller’s account — for companies and entrepreneurs, against an invoice provided by our manager.
4.3. Discounts, promotions and gift cards apply on the terms shown on the Website at the time of the Order.
5. Pre-orders
If a Product is available for pre-order, the estimated dispatch date is shown on the product page. The Seller ships the Product on that date, give or take 2 days. If the date changes, the Seller notifies the Buyer, who may accept the new date or receive a refund.
6. Delivery
6.1. Within Ukraine, Products are delivered by Nova Poshta. Paid Orders are dispatched within 1–2 business days. Delivery is paid by the Buyer at the carrier’s rates.
6.2. Outside Ukraine, Products are delivered by Ukrposhta; estimated delivery time is 7–21 days. Customs duties, taxes and fees of the destination country are paid by the Buyer. We do not deliver to russia, belarus or North Korea.
6.3. After dispatch the Seller sends a tracking number. Ownership and the risk of accidental damage pass to the Buyer upon receipt of the Products.
7.1. The Buyer may exchange or return Products of proper quality within 14 days of receipt, provided they have not been used and their original condition is preserved. Shipping of the Products back to the Seller is paid by the Buyer.
7.2. To arrange an exchange or return, the Buyer contacts the Seller by any method listed in section 1; our manager will provide the return address.
7.3. Refunds are made to the same card or account used for payment, after the Seller receives the Products, within the time limits set by Ukrainian law.
8.1. The Seller guarantees that Products match their description on the Website and comply with Ukrainian law. Slight differences in colour may occur due to screen settings.
8.2. If the Buyer finds a manufacturing defect, the Seller, at the Buyer’s choice, replaces the Product or issues a refund in accordance with the Law of Ukraine “On Consumer Rights Protection”. In this case the Seller pays for shipping both ways.
8.3. The warranty does not cover defects caused by normal wear and tear, mechanical damage, improper use or care, or self-repair.
9. Rights and obligations
9.1. The Seller undertakes to deliver Products matching the Order within the agreed time and to provide the Buyer with the information required by law.
9.2. The Buyer undertakes to provide accurate details, pay for and collect the Products. If the Buyer does not collect a cash-on-delivery parcel, the Seller may claim reimbursement of shipping costs both ways.
10. Liability and force majeure
The parties are liable for failure to perform their obligations in accordance with Ukrainian law. The parties are released from liability if non-performance is caused by force majeure, including hostilities, air raid alerts, power outages, and disruptions of carriers and payment systems. The Seller is not liable for delays caused by the carrier.
11. Personal data
By placing an Order, the Buyer agrees to the processing of their personal data to perform the contract in accordance with the Privacy Policy.
12. Disputes
Disputes are resolved through negotiation and, failing agreement, in accordance with Ukrainian law. Please send any claims about an Order to [email protected]. This does not limit any mandatory consumer rights you may have under the law of your country of residence.
13. Changes to the Offer
The Seller may amend this Offer by publishing a new version on the Website. An Order is governed by the version in force at the time it was placed.
